This Privacy Policy describes how Tally Technologies LLC (“Tally,” “we,” “us,” or “our”) collects, uses, and protects information in connection with the Tally receptionist platform and our SMS text messaging service. Tally is a technology provider: we supply AI receptionist and messaging tools to service businesses (our “Business Customers,” such as salons). When a Business Customer uses our platform, we also process information about that business’s own customers (“End Users”) on the business’s behalf. This policy covers both relationships.
1. Information We Collect
From our Business Customers, we collect account and contact details (business name, address, owner/staff names, email, phone), the business information and scripts they configure, and billing details processed by our payment processor (Stripe).
From End Users — the customers of a business that uses Tally — we may collect, on the business’s behalf: your mobile phone number, the content of calls and text messages you exchange with the business’s AI receptionist, your name and contact details (if provided), and information about your appointment needs.
2. SMS Messaging Program
Program description: Tally provides a virtual (AI) receptionist and text-messaging service to service businesses. When you call or text a business that uses Tally — for example, a hair salon — the business may respond by text: its AI receptionist can send you an SMS message containing a link to book an appointment online, reply to your inquiry, or (on plans without an AI receptionist answering calls) text you back after a call the business was unable to answer. These messages are sent by Tally on behalf of the business, are sent from a phone number assigned to that business, and display the business’s name. Messages are transactional only and respond to your own call or message to the business; we do not send marketing or promotional texts through this program.
How you opt in: There are two ways messages start. (1) During an answered call: the AI receptionist tells you it can text you a booking link, notes that message and data rates may apply and that you can reply STOP to opt out, and asks your permission; we send the booking-link text only if you verbally agree. (2) After your call or text to the business: if you call a business that uses Tally and your call is not answered or does not result in a booking, or if you text the business first, the business may send you a text reply with a booking link or a response to your inquiry, based on your contact with the business. In all cases, consent is not a condition of any purchase, you can reply STOP at any time, and for every message we send we keep a record of the mobile number, the date and time, and the basis for the message (your verbal consent or your inbound call or text).
How to opt out: Reply STOP to any message at any time to stop all messages. You will receive one final confirmation message and no further messages unless you contact the business again and request one.

Message frequency: Typically one message per inbound call or missed call. If you text with the business, you will receive replies within that conversation, which on some plans may be generated by the business’s AI assistant. We do not send recurring or automated marketing messages.
Message and data rates: Message and data rates may apply depending on your mobile carrier and plan. We are not responsible for any charges from your carrier.
Messages Tally sends as Tally (our own business line): This paragraph describes the SMS program operated under our registered brand name, Tally AI. Separately from the on-behalf-of-business messaging described above, Tally itself sends text messages from its own business line, (801) 797-1771, to owners and managers of businesses such as salons. We text a business owner only after they have asked us to. There are three ways that happens, and every message we send is tied to one of them: (1) the owner entered a mobile number and ticked an unchecked SMS consent box on one of our web forms; (2) the owner gave us permission verbally while speaking with a member of our team, who asks “Can I text you that at this number? Message and data rates may apply, and you can reply STOP to opt out anytime”; or (3) the owner called or texted our business line first and we replied within that conversation. Ticking the box is never required to sign up for, purchase, or receive anything from us. These messages are conversational and written by a person one at a time — we do not send automated blasts, bulk marketing, or recurring campaigns from this line, and we do not text businesses that have not contacted us or given consent. Every message identifies Tally and tells the recipient they can reply STOP to opt out and HELP for help; we honor STOP immediately, message frequency varies, message and data rates may apply, and we never sell or share a recipient’s phone number or opt-out status with third parties for marketing. Mobile phone numbers and SMS opt-in data will not be sold, rented, or shared with third parties, affiliates, or lead generators for marketing purposes, and no mobile information is shared with data brokers. For each message we keep a record of the mobile number, the date and time, and the consent it rests on — including the exact disclosure wording shown on screen for a web opt-in. 3. Calls, Recordings, and AI Processing
When you call a business that uses Tally, your call is answered by an automated (AI) virtual receptionist that uses speech and language processing to understand your request, answer questions, and help schedule appointments. Calls and text messages may be recorded and transcribed so the service can operate and so the business can review its own customer interactions. The business you contacted is responsible for providing any notices and obtaining any consents required by law for call recording or monitoring in your location. You may ask to be connected to a person, or contact the business directly, at any time.
We process the content of your calls and messages solely to provide, secure, and improve the service on the business’s behalf. We do not sell this content, and we do not use it for our own marketing or for third-party marketing. Where our AI and communications providers process this content, they do so only to deliver the service to us and are contractually restricted from using it for their own purposes.
4. How We Use Information
We use Business Customer information to provide, bill for, secure, and support the platform. We use End User information solely to deliver the service the business has requested — answering calls, scheduling appointments, sending booking links, and providing customer support — on the business’s behalf. We do not use End User information for our own marketing, and we do not use it for marketing purposes without explicit consent.
5. Information Sharing
We will never share or sell mobile phone numbers or SMS opt-in/consent data with third parties or affiliates for marketing or promotional purposes. No mobile information is shared with marketing companies, lead generators, or data brokers. SMS opt-in consent is not shared with any third party.
We share information only as needed to operate the platform and deliver the service:
- With the Business Customer whose receptionist you contacted — they receive the call and message records for their own customer relationship.
- With service providers that operate the platform on our instructions (processors, not independent marketers): Twilio (telephony and SMS delivery), ElevenLabs (AI voice), Anthropic (AI text processing), Square and similar booking/point-of-sale systems (appointments), Supabase (secure data hosting), and Stripe (Business Customer billing). These providers may process information only to perform services for us and are not permitted to use it for their own marketing. They are not “third parties” in the marketing sense described above.
- When required by law, or to protect the rights, safety, and security of Tally, our Business Customers, or others.
6. Data Retention
We retain information only as long as necessary to provide the service to our Business Customers, to meet legal, tax, and compliance obligations (including records of messaging consent), or as otherwise required by law. End Users may request deletion of their information by contacting us or the relevant business.
7. Data Security
We take commercially reasonable steps to protect information from unauthorized access, including access controls and encrypted data hosting. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
8. Website Cookies, Analytics, and Advertising
Our website (gettallyai.com and app.gettallyai.com) uses cookies and similar technologies from third-party services to understand how visitors use the site and to measure our advertising: Google Analytics (site usage), Google Ads (ad conversion measurement), and the Meta (Facebook) Pixel (ad measurement and audiences). These tools may collect your IP address, device and browser information, and pages visited, and may set cookies or use similar identifiers. This applies to website visitors; we do not use these advertising tools on the content of calls or text messages. You can limit this collection through your browser's cookie controls, Google's Ads Settings (adssettings.google.com), and Meta's ad preferences, or with tools like the Google Analytics opt-out browser add-on.
9. Children’s Privacy
Our services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us information, contact us and we will delete it.
10. Supported Carriers
Our SMS service is supported by all major US carriers, including AT&T, Verizon, and T-Mobile, among others. Carrier support may vary, and carriers are not liable for delayed or undelivered messages.
11. Your Choices and Roles
For information processed on a Business Customer’s behalf, that business is the data controller: it controls the data and is responsible for providing privacy notices to its customers and for obtaining any consents required by law, including any call-recording or monitoring notices required in the customer’s location. Tally sends text messages only in response to your contact with the business — your verbal consent on a call, your missed call, or your own text — and honors STOP at any time. If you are an End User and want your information accessed, corrected, or deleted, you may contact the business directly or contact us and we will route your request appropriately.
